Background

Maritime New Zealand (MNZ) is developing MOSS (Maritime Operator Safety System) – a proposed new framework to improve maritime operator safety. 

To achieve this, we are proposing changes to the rules that guide what is currently known as the Safe Ship Management (SSM) system: Rule Parts 21 and 46.

This proposal involves replacing maritime Rule Part 46, which guides surveys, certification and maintenance, with the proposed Rule Part 44; and maritime Rule Part 21, which guides the certification of maritime transport operators, with the proposed Rule Part 19. 

In April 2010, MNZ released two draft rules for public consultation and received a significant response: 102 written submissions were received by the consultation closing date, with 13 oral submissions later presented to the MOSS Submissions Panel.

These submissions were analysed and MNZ has prepared a detailed response to the points made.

Further work has been undertaken in response to the submissions, and changes made to the proposed rules. MNZ has decided to open a new consultation round to enable the maritime community to consider these changes.

Public meetings

We will be visiting a number of cities and towns throughout May 2012 to discuss the proposed changes. The purpose of these meetings is to help your understanding of the proposals, rather than to get feedback.

Oral submissions

A panel of Maritime New Zealand representatives will hear oral submissions at public hearings during June 2012. If you want to make an oral submission you need to tell us before 18 May 2012, and follow the process for oral submissions described in the Invitations to Comment.

Once the consultation process is complete, the panel will consider the key issues and decide on any changes that need to be made to the rules. It is anticipated that this stage will take until July 2012.

The draft rules, with any revisions, will then be provided to the Maritime New Zealand Authority for consideration. It is anticipated that the Ministry of Transport will receive the rules as ‘final drafts’ for Ministerial approval in September.

Historical review of our safety management systems

In 2002, Thompson Clarke Shipping Pty Ltd conducted an independent review for Maritime Safety Authority (now Maritime New Zealand) of its Safe Ship Management (SSM) Systems on commercial non-SOLAS vessels in New Zealand. The review assessed the ability of the SSM and Safe Operational Plan management systems to effectively deliver safety at a reasonable cost.

In response, the Office of the Auditor General produced a report in December 2005 outlining how Maritime New Zealand could approach the recommendations that Thompson Clarke made in its 2002 report.
