Maritime New Zealand administers the provisions of the Health and Safety in Employment Act 1992 for the maritime sector. Learn what this means for those onboard New Zealand ships.
This Act, also know as the HSE Act; came into force in April 1993.
Coverage under the Act includes seafarers working onboard New Zealand ships and for ships as places of work; as well as all those who are onboard on business. For example pilots, ships' agents, stevedores, provedores, surveyors, contractors and so on.

Health and safety for seafarers on New Zealand ships was previously administered by the Ministry of Transport and covered by Part II of the Maritime Transport Act 1994.

Health and safety onboard a ship is dealt with by Maritime New Zealand's Maritime Safety Inspectors and Accident Investigators, in much the same way as was previously under the Maritime Transport Act.
Health and safety issues that arise ashore are still dealt with by the Occupational Safety and Health Service (OSH) of the Department of Labour.
The two services, Maritime New Zealand and the Occupational Safety and Health Service, work closely together to ensure there are no gaps in coverage.
The obligation to report accidents, incidents and mishaps that occur onboard to Maritime New Zealand continues under both the Maritime Transport Act and the Health and Safety in Employment Act.
There are two reporting forms to complete:
