Mr Jolly operated Karen Anne without the required Safe Ship Management Certificate (the maritime equivalent of a warrant of fitness for a commercial vessel) and then breached detention orders placed on her in May last year.
Mr Jolly advised Maritime New Zealand that he had no intention of complying with the detention and would continue to fish.
Maritime New Zealand charged Mr Jolly for both continually breaching the detention order and continually operating the Karen Anne without a Safe Ship Management certificate.
Director of Maritime NZ, Russell Kilvington, says the decision sends a clear reminder to all commercial seafarers about their obligations to comply with Maritime Rules.
“The Rules are there to help all vessels operate in manner that keeps them and their crews safe.
“We will not tolerate those who flagrantly breach Rules and ignore detention orders and are very satisfied that the Court has supported our action.”
